Terms of service

These terms apply when you use Eulogy Kit (the “service”), operated by Eulogy Kit (“we”, “us”). By starting the interview or paying for a kit you agree to them. They are written in plain language on purpose; where a heading and the text below it differ, the text applies.
1. What you are buying
Eulogy Kit is a personalised digital product. You answer a fixed set of questions, pay once, and receive a written kit (a eulogy, cue cards, an obituary and notices, service words, suggested readings, a delivery guide, thank-you notes and a verification checklist) generated from your answers and delivered instantly at a private link. The kit includes 2 self-serve rewrites. The price is $39 in US dollars, paid once, with no subscription and no further charges.
2. No accounts; the private link is the only access
There are no accounts, passwords or logins. Your kit is reachable only through the private link shown after payment and printed on your Stripe receipt. The link is unguessable and works for as long as we operate the service, which we intend to be at least two years from purchase. We hold no email address for you, so if the link and the receipt are both lost we cannot recover it. The print and download buttons on the kit page are your own durable copy; please use them as soon as the kit arrives.
3. Payment
Payment is processed by Stripe on Stripe’s hosted checkout page. We never see or store your card details. Stripe sends the receipt email; we send no email. Nothing is generated before Stripe confirms the payment.
4. Rewrites
You may request up to 2 rewrites from the kit page by describing the change you want in a short note. Each rewrite replaces the previous version of the kit; copy or print anything you want to keep first. Rewrites do not extend the refund window.
5. Refunds
You may refund the order yourself, for any reason, for 7 days after the kit is delivered, using the button at the bottom of the kit page. After a refund the kit page is no longer available. If our system fails to produce your kit after three attempts, you are refunded automatically. The full policy is at /refunds and forms part of these terms.
6. Your answers and the kit
You confirm that you are entitled to share the information you type, including the names of other people, for the purpose of preparing a eulogy, obituary and related texts. You keep ownership of what you type. We assign to you whatever rights we hold in the generated kit, and you may read, print, publish, adapt and share it freely, including submitting the obituary to newspapers and funeral homes. The suggested readings are reproduced only where they are in the public domain; where they are not, we give the title and author so you can find the text yourself.
7. Accuracy is yours to check
The kit is generated by software from your answers, exactly as typed, in a single pass without human review. Names, dates, ages, places and relationships are not verified by us and cannot be. The first section of every kit is a checklist for exactly this purpose. Read everything before it is spoken or printed. The kit is not a substitute for the funeral home’s or newspaper’s own requirements, and it is not legal, medical, financial or religious advice.
8. Acceptable use
Use the service only to prepare texts for a memorial, funeral or bereavement. Do not use it to harass, defame or impersonate anyone, to write about a living person as though they had died, or to submit content you have no right to share. We may decline to generate, and refund, any order that our safeguards flag.
9. Not affiliated
Eulogy Kit is not affiliated with, endorsed by, or acting for any funeral home, newspaper, cemetery, place of worship or religious organisation. Conventions described on the site are general; the organisations you deal with may have their own requirements.
10. Availability and changes
We aim to keep the service and your link available continuously, but we do not guarantee uninterrupted access. We may change the questions, the sections of the kit, the price for new orders, or these terms at any time; the terms in force when you paid apply to your order. If we discontinue the service we will keep existing links available for at least the period described in section 2 where it is within our control.
11. Liability
To the fullest extent permitted by law, our total liability to you for any claim connected with the service is limited to the amount you paid for the kit. We are not liable for any loss arising from errors in the kit that the verification checklist and a careful reading would have revealed, from a lost link, or from the use you make of the kit. Nothing in these terms limits liability that cannot be limited by law, including any statutory rights you have as a consumer.
12. Privacy
How we handle your answers and the kit is described in the privacy policy, which forms part of these terms. In short: your answers and the kit are stored as metadata on your Stripe payment record, visible only through your private link, and are used for nothing else.
13. Governing law
These terms are governed by the laws of New York, United States, and any dispute will be heard in the courts of New York, United States, except where the consumer law of your country of residence gives you protection that cannot be excluded.
14. Contact
Support is self-serve: rewrites and refunds are buttons on your kit page. There is no inbox to write to, which is how we keep the price at $39. Requests that cannot be met by those buttons, such as a request to delete your data, are described in the privacy policy.
